High-Rise Fires and Post-Disaster Responsibility: Comparing Grenfell and Wang Fuk Court

The November 2025 fire at Wang Fuk Court in Tai Po, Hong Kong, and the 2017 Grenfell Tower disaster in London are often discussed as tragic failures of building safety. Yet beyond their immediate physical causes, both incidents reveal how risk in high-rise housing is produced and managed through institutional design, regulatory practice, and post-disaster response. Although the two fires occurred in very different political and legal contexts, they expose common patterns of vulnerability in vertical urban environments, where renovation practices, fragmented oversight, and information gaps can transform localized hazards into systemic failures.

Drawing on socio-technical risk theory, which understands disasters as the result of interactions between technical systems, institutional decisions, and social structures rather than purely individual failures, this article approaches both fires not merely as isolated emergencies, but as governance failures unfolding across the lifecycle of high-rise buildings. From evacuation and emergency response, to compensation and accountability, questions of fire safety and disaster redress emerge within broader questions of how legal systems allocate responsibility and manage risk in increasingly vertical cities. The contrast between Grenfell and Wang Fuk Court therefore reflects not only differences in fire dynamics or emergency management, but fundamental differences in how legal systems allocate responsibility and provide redress in the aftermath of large-scale housing disasters.

1. How Façades Become Fire Pathways: Structural and Material Conditions

In both Hong Kong and London, the building envelope functioned not as a barrier but as a facilitator of uncontrolled fire spread. At Wang Fuk Court, extensive bamboo scaffolding, plastic mesh and foam insulation were installed as part of the renovation works. Investigative reporting suggests that the renovation scaffolding and protective mesh around Wang Fuk Court’s exterior likely fueled the rapid vertical spread of the fire, as substandard plastic mesh and insulation materials helped carry flames across multiple buildings.

At Grenfell Tower, the danger came from the permanent exterior wall system. The aluminum composite material (ACM) cladding with a polyethylene core played a central role in allowing flames to bypass internal fire compartmentation. The system created a chimney-like effect that accelerated the fire up the exterior of the building.

Scholars refer to these issues as process-based vulnerabilities, meaning risks that arise not only from material properties but from construction and refurbishment sequences. Whether temporary or permanent, façade systems in transition can produce risk profiles fundamentally different from those envisioned by the original design.

2. Regulatory Ecosystems: Fragmented Oversight and Divergent Reforms

Both jurisdictions had comprehensive regulatory frameworks in place before the fires. However, both systems exhibited regulatory fragmentation, a condition in which multiple institutions hold partial responsibility without unified oversight.

In Hong Kong, the statutory framework is governed primarily by the Buildings Department and the Fire Services Department under the Buildings Ordinance (Cap. 123). Renovation works and temporary structures are handled through additional technical codes. Yet, these regulatory fragments seldom operate in concert. Renovation activities may proceed without triggering comprehensive fire-risk review, and temporary façade coverings may fall into regulatory gaps.

Similarly, prior to 2017, the United Kingdom’s system divided responsibilities among local authority building control, private approved inspectors and fire-and-rescue services. The Hackitt Review suggested that “there is a need for a radical rethink of the whole system” and how it works, and criticized the existing regulatory framework for a lack of clarity on roles, responsibilities and oversight.

The regulatory paths of these incidents diverged sharply after Grenfell. The United Kingdom enacted the Building Safety Act 2022 and established the Building Safety Regulator to oversee high-risk buildings through their entire lifecycle. This reform signaled a shift toward coordinated structural governance.

In contrast to the UK’s post-Hackitt Review reforms, including the establishment of a consolidated Building Safety Regulator to oversee building and fire safety regulation, Hong Kong’s building safety regime remains distributed across multiple government departments, such as the Buildings Department and the Fire Services Department, without a unified authority specifically mandated to assess and manage interacting risks.

Academic research reviewing Hong Kong’s fire safety legal framework notes that multiple statutory instruments and enforcement responsibilities are distributed across different regulatory domains, resulting in a complex system of departmental roles rather than a single consolidated authority. Scholars of fire safety management further argue that “control by legislation by a single government department is strongly recommended.” 

In this respect, Hong Kong prior to the Wang Fuk Court fire bears some resemblance to the fragmented regulatory environment identified in the United Kingdom before the Grenfell Tower disaster, where responsibilities for building standards, fire oversight, and housing governance were similarly dispersed across multiple actors and agencies. 

In Hong Kong, however, there has not yet been a similarly comprehensive reform aimed at consolidating regulatory authority within a more unified governance framework, although the relative recency of the Wang Fuk Court fire means that longer-term institutional reforms may still be evolving.

3. Information Transparency: Knowledge Gaps and Systemic Blindness

High-rise safety depends on accurate and accessible information about building materials, design modifications, and renovation practices. Both disasters revealed the consequences of informational opacity.

The Grenfell Tower Inquiry documented widespread uncertainty among contractors, regulators, and residents regarding the cladding system’s composition, installation, and fire performance. The lack of reliable documentation created a blind spot that allowed dangerous materials to be installed without adequate scrutiny.

At Wang Fuk Court, residents reported equally limited knowledge of the materials added to the building’s exterior during renovation. Temporary coverings and insulation significantly altered the building’s fire behavior, yet no comprehensive or publicly accessible building-safety record existed to make these changes visible.

In response to these issues, the United Kingdom adopted the “golden thread” requirement, a digital, continuously updated building-safety information system intended to follow a structure throughout its life. 

At present, official Hong Kong government building safety policies and regulatory frameworks do not indicate the establishment of a digital, lifecycle-wide, statutory building information system comparable to the UK’s golden thread. The closest official digital initiative is the use of Building Information Modelling (BIM) as a design and lifecycle data representation tool, but this does not constitute a statutory building safety information regime like the golden thread required under the UK’s Building Safety Act 2022.

4. Emergency Response: Vertical Cities and the Limits of Evacuation Protocols

Fire evacuation in high-rise buildings involves risk dynamics that differ fundamentally from those in low-rise settings. At Grenfell, the long-established “stay put” approach was grounded in assumptions of effective internal compartmentation and formed a core feature of high-rise fire safety guidance prior to the disaster. Once flames breached the façade and enabled rapid external fire spread, these assumptions collapsed, as documented in the Grenfell Tower Inquiry Phase 1 Report. The fire’s vertical and external progression undermined the logic of staggered or delayed evacuation, revealing the structural limits of evacuation protocols designed around internal fire scenarios rather than façade-driven events, a failure further examined in Reuters’ reporting on inquiry evidence that the stay-put policy failed. In response to these failures, the Grenfell Tower Inquiry recommended the introduction of Personal Emergency Evacuation Plans (PEEPs) for residents of high-rise residential buildings, particularly those unable to self-evacuate.

At Wang Fuk Court, evacuation complexity manifested differently but with similar systemic consequences. Thick smoke billowed from multiple residential blocks during the fire, severely degrading visibility and complicating movement through shared spaces, while bamboo scaffolding and renovation materials wrapped around the buildings’ exteriors altered both the physical accessibility of exits and the predictability of evacuation paths.

Taken together, the two incidents illustrate how emergency response in vertical cities is shaped by the interaction of multiple subsystems, including building design, façade and renovation practices, information flows, and human behavior, rather than by any single point of failure. As described in Charles Perrow’s theory of normal accidents in Normal Accidents: Living with High-Risk Technologies, tightly coupled and complex systems can produce catastrophic outcomes when multiple failures interact in unanticipated ways. In high-rise environments, evacuation protocols that assume stable conditions and clear escape routes may therefore prove insufficient when confronted with rapidly evolving fire scenarios involving simultaneous structural, informational, and human-system failures. 

As disaster governance scholarship has long emphasized, the consequences of catastrophic events are rarely confined to the moment of emergency response. Failures in risk management often expose deeper institutional arrangements that shape how harm is distributed and addressed over time. When evacuation protocols fail to contain harm in high-rise disasters, the breakdown of evacuation assumptions transforms fire incidents from operational failures into systemic governance questions, shifting attention from how residents escape danger to how institutions respond after the harm has occurred. 

It is at this stage, after lives have been lost and displacement has taken place, the legal frameworks governing compensation, accountability, and responsibility become decisive. 

5. Post-Disaster Compensation and Responsibility: Two Fundamentally Different Models

The clearest divergence between the two jurisdictions lies in their approaches to compensation and responsibility after disaster. This institutional contrast reveals deeper differences in how each system conceptualizes harm, accountability, and justice.

A. The United Kingdom: A Multi-Layered System of Redress

In the United Kingdom, post-disaster redress following the Grenfell Tower fire has developed through a multi-layered framework that integrates private law liability, human rights obligations, administrative compensation, and public inquiry mechanisms

Beyond private law remedies, the United Kingdom’s response has been shaped decisively by its obligations under Article 2 of the European Convention on Human Rights, which has been interpreted by the European Court of Human Rights as imposing positive obligations on the state to protect life, including duties to establish effective regulatory frameworks and to respond adequately to known or foreseeable risks. These positive obligations have informed both the scope of state responsibility and the legal framing of post-disaster accountability following Grenfell.

Administrative redress has constituted a further layer of response. The UK government introduced targeted support measures for those affected, alongside national remediation programs addressing unsafe cladding and building safety defects, including the Cladding Safety Scheme and related funding initiatives. These measures reflect a policy choice to supplement individual litigation with collective, state-backed remediation and financial support.

Crucially, the United Kingdom deployed a comprehensive statutory public inquiry under the Inquiries Act 2005 to investigate the Grenfell disaster. The Grenfell Tower Inquiry has served as a central fact-finding mechanism, producing an authoritative public record of systemic failures across regulatory oversight, industry practices, and emergency response. This evidentiary foundation has not only informed civil litigation but has also driven legislative reform, most notably through the Building Safety Act 2022 and the establishment of the Building Safety Regulator.

Taken together, these elements illustrate a post-disaster model in which responsibility and redress are distributed across multiple institutional channels. Tort liability, human rights law, administrative compensation, and public inquiry processes operate in tandem, enabling both individualized remedies and systemic accountability. In contrast to more fragmented approaches, the UK model demonstrates how layered governance structures can transform a housing disaster into a catalyst for legal reform, regulatory consolidation, and long-term institutional learning.

B. Hong Kong: A Tort-Centered and Fragmented Response Structure

In Hong Kong, post-disaster redress for victims of the Wang Fuk Court fire is anchored primarily in private law remedies, most notably negligence claims under the Tort Ordinance (Cap. 21) and the Occupiers Liability Ordinance (Cap. 314). Potential defendants include contractors, material suppliers, and property managers involved in the construction, renovation, or maintenance of the affected buildings. In practice, however, fires involving multiple interacting factors such as construction methods, material performance, and regulatory oversight make it particularly difficult for claimants to establish breach of duty and causation. Similar evidentiary difficulties have also been observed in construction defect litigation, where courts often struggle to isolate a single legally attributable cause among multiple interacting technical and managerial failures. This is a challenge widely recognized in tort law scholarship on complex and multi-causal harm, for example, in analyses of causation and liability scope in construction and disaster contexts.

Unlike jurisdictions operating under human rights frameworks that impose positive obligations on the state to protect life, most notably under Article 2 of the European Convention on Human Rights, Hong Kong operates within a constitutional order defined by the Basic Law of the Hong Kong Special Administrative Region. The Basic Law does not articulate a comparable doctrine of positive state responsibility in relation to life-threatening risks arising from regulatory failure

Judicial compensation mechanisms in Hong Kong remain limited in the context of large-scale housing disasters. Hong Kong does not currently maintain a formal class action regime and instead relies primarily on the traditional representative proceedings mechanism under Order 15, Rule 12 of the Rules of the High Court. The Hong Kong Law Reform Commission recommended the introduction of a comprehensive class action system in its 2012 Report on Class Actions, particularly to improve access to justice in cases involving numerous affected parties, but such reforms have not yet been implemented. As a result, victims of large-scale incidents may face significant procedural and financial barriers when pursuing fragmented individual claims, especially where losses involve indirect harm, temporary displacement, psychological injury, or complex questions of causation involving multiple actors and regulatory bodies.

6. Governance Lessons for High-Rise Cities: Beyond Structural Risk

The comparison between Wang Fuk Court and Grenfell demonstrates that fire safety and post-disaster redress cannot be treated as isolated or purely technical concerns. Instead, both must be understood as components of a broader lifecycle governance challenge, in which risk is produced, managed, and redistributed across design, construction, renovation, occupation, and post-disaster phases. In particular, renovation periods emerge as critical moments of heightened vulnerability, where process-based risks intensify, and existing regulatory assumptions may no longer hold. The experience of the United Kingdom’s golden thread framework illustrates how robust, continuously updated information systems can play a central role in mitigating these risks, enhancing institutional oversight, and supporting both prevention and post-disaster accountability.

The divergence in post-disaster redress mechanisms further reveals the limits of relying on tort law as the primary vehicle for addressing harm in complex urban disasters. While private law remedies remain important, they are often ill-suited to capture systemic failures involving multiple actors, regulatory fragmentation, and long-term displacement. Scholarship on joined-up governance underscores the importance of coordination across legal, administrative, and regulatory institutions in responding to such multi-dimensional risks. From this perspective, effective governance of high-rise cities requires not only structural safety measures but also integrated frameworks that align information flows, responsibility allocation, and remedial mechanisms across institutional boundaries.

Conclusion

The Wang Fuk Court and Grenfell Tower fires illustrate how combustible façade conditions, renovation practices, and fragmented regulatory oversight can combine to produce catastrophic outcomes in high-rise residential developments. The two cases reveal fundamentally different institutional responses when systemic failures result in loss of life.

In the United Kingdom, post-disaster governance has evolved into a layered framework that integrates tort-based remedies, administrative compensation, human rights obligations, and statutory public inquiries. In contrast, Hong Kong’s response remains centered primarily on private law litigation, supplemented by limited administrative support and dispersed fact-finding processes. These differences are not merely procedural, they reflect deeper variations in how responsibility, risk, and redress are conceptualized within each legal system.

As cities worldwide continue to grow vertically and building refurbishment cycles become more frequent, the comparative lessons drawn from these two fires assume broader relevance. Fire safety and disaster compensation can no longer be approached solely as technical or engineering problems. Rather, they must be understood as governance challenges that hinge on institutional design, information infrastructures, and legal frameworks. Viewed in this light, the experiences of Grenfell and Wang Fuk Court offer a critical foundation for rethinking how accountability, prevention, and justice might be more effectively integrated within the built environments of increasingly vertical urban societies.
